These Terms govern your use of Fitlyst. By creating an account or using the platform, you agree to them.

1. What Fitlyst is

Fitlyst is a marketplace that helps clients discover, book, and pay independent fitness and wellbeing professionals ("Trainers"). Fitlyst does not provide training services; trainers do. We provide the platform, payments, and support features.

2. Accounts & eligibility

  • You must be 18+ to create an account. Minors may train only with verifiable parental/guardian consent and under a Trainer's policies.
  • Keep credentials secure. You are responsible for activity under your account.
  • We may suspend or terminate accounts that violate these Terms or our Acceptable Use Policy.

3. Bookings, relationship, and conduct

  • When a client books a session, the contract is between the client and the Trainer.
  • Trainers set services, pricing, availability, and policies (subject to law and our policies).
  • You agree to be professional, truthful, and compliant with our Acceptable Use Policy and applicable health & safety laws.

4. Payments, fees, and refunds

  • Payments and payouts are processed by Stripe; Trainers must onboard to Stripe Connect.
  • Fitlyst charges a platform fee disclosed at checkout/onboarding.
  • Refunds: Trainer policies apply (plus mandatory consumer rights where applicable). Fitlyst may facilitate refunds via Stripe but is not the merchant of record for training services.
  • Chargebacks: You authorise us to share relevant information with Stripe and the counterparty. Where a chargeback is lost, we may deduct amounts from payouts or charge a payment method.

5. Cancellations & no-shows

  • Each Trainer sets their cancellation/no-show policy (must be clear before booking). Platform-wide minimums may apply to protect users.
  • If a Trainer cancels, clients are entitled to a refund or rebooking.

6. Health & safety; no medical advice

  • Trainers are solely responsible for ensuring sessions are safe and appropriate for the client.
  • Fitlyst does not provide medical advice. Clients should consult a healthcare professional before beginning any fitness program.
  • Trainers must hold required qualifications/insurance where applicable.

7. Acceptable Use & content

  • You may not post illegal, harmful, or infringing content or misuse the platform (see Acceptable Use Policy).
  • You retain ownership of your content. You grant Fitlyst a non-exclusive, worldwide, royalty-free licence to host, display, and distribute your content on the platform to operate and improve the service.

8. IP; branding

The platform, software, and branding are owned by Fitlyst or its licensors. No rights are granted except as necessary to use the service as intended.

9. Disclaimers; limitation of liability

  • The service is provided "as is." We do not guarantee outcomes, availability, or error-free operation.
  • To the maximum extent permitted by law, Fitlyst is not liable for indirect, incidental, or consequential damages, or for injuries arising from trainer services.
  • Our total liability to you for claims arising out of or relating to the service will not exceed the greater of (a) £100 or (b) the amounts paid by you to us in the 12 months prior to the claim.

10. Indemnity

You agree to indemnify and hold Fitlyst harmless from claims arising from your misuse, your content, or your violation of laws or third-party rights.

11. Termination

You may stop using Fitlyst at any time. We may suspend or terminate access for breaches, risk, or legal reasons. Certain clauses survive termination (e.g., payments, liability, IP).

12. Changes; notices; law

  • We may update these Terms. We'll notify you of material changes. Your continued use constitutes acceptance.
  • Governing law: England & Wales. Disputes are subject to the exclusive jurisdiction of its courts (or you can propose mediation first).
